1. Agreement and operator

These Terms & Conditions form a legal agreement between you and Pizza Digital Limited, Company Registration No: 11562301, 60 Tottenham Court Road, Suite 4843a, W1T 2EW, London, United Kingdom, regarding your use of MagicBite, including the mobile application, website, and related services. By accessing or using MagicBite, you agree to these terms. If you do not agree, do not use the service.

2. Eligibility and account use

You must provide accurate information when creating and using your account and keep your credentials confidential. You are responsible for activity that occurs under your account. You agree to use MagicBite only for lawful purposes and in accordance with these terms.

3. License

Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use MagicBite on devices you own or control. You may not:

• copy, rent, lease, sell, sublicense, or redistribute MagicBite except as expressly permitted by law
• reverse engineer, decompile, disassemble, or attempt to derive source code except where mandatory law permits it
• interfere with or disrupt the integrity, security, or performance of the service
• use MagicBite to upload unlawful, infringing, abusive, or harmful content

4. Product features

MagicBite may include features such as meal scan, text logging, food search, favorites, calorie and macro summaries, nutrient dashboards, hydration tracking, fasting tracking, progress features, and AI coaching. Features may change, evolve, or be withdrawn at any time.

5. User content and submitted data

You retain ownership of the information and content you submit, including meal entries, coach messages, images, favorites, notes, and profile information. You grant us the rights reasonably necessary to host, store, process, transmit, analyze, and display that content in order to operate, secure, improve, and support MagicBite.

6. Automated outputs, meal scan, and coaching

Meal scan, food search, nutrient analysis, and coaching outputs may rely on automated systems, AI models, and third-party data sources. Those outputs are intended to support general food journaling and nutrition awareness only. They may be incomplete, estimated, delayed, or inaccurate. You are responsible for how you interpret and use any information generated by MagicBite.

7. Subscriptions and billing

MagicBite may offer free and paid features. If paid subscriptions or in-app purchases are offered:

• pricing will be shown before purchase
• subscriptions may renew automatically unless cancelled through the relevant app store account
• billing, cancellation, and refunds are generally handled by the platform provider, subject to its rules
• we may change pricing or packaging in the future in accordance with applicable law and platform requirements

8. Health, safety, and medical disclaimer

MagicBite is provided for general nutrition, food journaling, and wellness information only. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for advice from a qualified physician, dietitian, or other healthcare professional. MagicBite AI is not a doctor, dietitian, emergency service, or medical device. Do not rely on MagicBite for emergencies, diagnosis, treatment decisions, or urgent medical-risk situations. If you have a medical concern or emergency, contact a qualified healthcare professional or local emergency services immediately.

9. Privacy

Your use of MagicBite is also subject to our Privacy Policy, which explains how we collect, use, store, and share information in connection with the service.

10. Availability and termination

We may suspend, limit, change, or terminate access to MagicBite at any time, including where necessary for maintenance, safety, legal compliance, technical reasons, or breach of these terms. You may stop using the service at any time by deleting the app and discontinuing use.

11. Warranty disclaimer

To the fullest extent permitted by law, MagicBite is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or connected with your use of MagicBite. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Governing law

If you are a resident of the UK or EU, these terms and your use of MagicBite are governed by the laws of your country of residence where required by applicable consumer law. Otherwise, these terms are governed by the laws of England and Wales, and disputes will be subject to the courts of England and Wales unless mandatory law provides otherwise.

14. Changes to the terms

We may update these terms from time to time. If we make material changes, we may post the updated version on the website, update the in-app notice, or use another appropriate method to notify you. Continued use of MagicBite after updated terms take effect means you accept the revised terms, except where applicable law requires a different process.
